Abstract (EN)

Knowing the considered disagreement in Sharia has a great importance in accepting the differences, reducing conflict and discord among Muslims in matters where disagreement is widespread. Due to the importance of this issue, this research has been devoted to studying the considered disagreement in Sharia by clarifying the concept of considered disagreement and what is intended by it in Sharia. The legitimacy of this type of disagreement, as the ruling on disagreement in the principles of Sharia, and the final rulings that do not require consideration and reasoning, such as; the obligation of the five daily prayers, the prohibition of self-killing, and other final rulings that do not accept disagreement have been explained. The research also dealt with the ruling on invoking disagreement and making it an argument for the permissibility of adopting any statement under the pretext of disagreement. We also mentioned the rules for considered disagreement and the stages that disagreement passed through from the era of the Messenger Muhammad (peace be upon) him to the era of the Imams and the emergence of jurisprudential schools of thought, and the reasons that led to jurisprudence in deriving rulings legitimacy from its evidence. The research also talked on other issues related to the considered disagreement: Such as clarifying the position of the Muslim and how he deals with significant disagreement, warning against division and abandoning disagreement that leads to hostility, and mentioning the importance of meeting and coalition that are considered great principles that Islam brought.
