Abstract (EN)

In Islamic law, the issue of obtaining the Shari'a provisions from the evidence has been done with great care by the competent people. While mujtahids were trying to derive a shar'i ruling from evidence, they first resorted to nass, and when they could not find evidence of it in verses, they resorted to ijtihad. As a result, different methods have emerged. At the beginning of these methods are the methods of mutakallimîn and fukahâ. Mujtahids wrote works to justify the methods they developed and to show the evidence of other methods as weak, and they criticized the views of other methods in these works. Imam es-Serahsi, who became famous as "Şemsü'l-eimme", in his work called Temhîdu'l-Fusûl fi'l-Usûl, which was written according to the fukahâ (al-Hanefîyye) method, while trying to base the views of Hanafis on method, he also cites the views of other sects. One of the jurists that Serahsi most cited and criticized in general is Shafii. In our thesis, we focused on the views that Serahsi attributed to Shafii in his work called Temhîdu'l-Fusûl fi'l-Usûl and the comparison of these views with the related issues in the works of both Shafi'i and Shafi'i scholars.
