Abstract (EN)
The interest is a civil fruition of a sum of money which functioning depending on time. In 6102 Turkish Commercial Code, the article 8 foresees the interest in commercial transaction can be agreed freely. According to TCC article 19/2 a agreement, which is commercial transaction for a party of agreement, it forms as commercial transaction for the other parties. In 6098 Turkish Obligations Code, the article 88 for capital interests, the article 120 for default interests bring upper limits and for considering these issues its a matter of discussions that which provision of law is should be applied even in doctrine and High Court jurisprudences. In these cases a dispute occurs because of the 6502 The Code About Consumers Protections interest provisions. And this ise the main spot of our work for thesis.
