Abstract (EN)

Every aspect of the daily life contains a form of legal relationship between people. These relationships can be both complex and simple, due to the development of economic life. Legal relationships usually manifest themselves in the form of "contracts". The legal order allows people the freedom to organize their legal relationships as they wish, within the limits set by the law. Contracts must be entered into with sound intention and binding declarations of the parties. However, in some cases, the intent of the parties may be undermined by mistake, fraud or duress. In such cases, the parties need the right to avoid in order to eliminate the consequences that have occurred against the will of the parties. In our study, the right to avoid due to a defect in consent and its consequences will be analyzed. Keywords: Defect in Consent, Right to Avoid, Partial Avoidance, Compensation.
