Abstract (EN)
Nowadays, the administrative audit becomes difficult in parallel with the extension of administration. From past to present, lots of innovations were made in Turkey for the sake of making audit. The principle of management for managed people in accordance with the rule of transparency is adopted rather than the principle of management for managing people. It is obvious that existing types of audit is ineffective and insufficient. In this study, we will try to explain the weaknesses and deficiencies of two types of audit, namely hierarchical audit and tutelage audit. It is ordinary that hierarchical audit is exploited and used for wicked purposes because it includes wide-ranging authorities. Besides that, although tutelage audit has not got a potential for causing a tremendous trouble than hierarchical audit, it causes actualization of bothers arising from central administration body. At the same time, workload of administrative justice, certain and safe way of resolution, is exceeded the ordinary level. It is undisputed that establishing a administration action and/or administration action by the way of administrative jurisdiction causes administration to lose its reputation. For certain there are different audit ways rather than these methods and we will analyze outstanding ones. However, the system of ombudsman with its organization, activities and enforcements is also present as an institution. In this thesis, we will focus on the system of ombudsman, known as Government Inspection Institution in our country, as a solution for the ineffectiveness and inadequacy of these two audit ways mentioned above. In 2010, some constitutional changes were made on the Turkish Constitution dated 1982. One of these changes is Government Inspection Institution predicted by the Article 74. Based on this article the new law numbered 6328 for Government Inspection Institution came into force and Government Inspection Institution is created. Until today, although Turkey has some similar agencies and institutions like Government Inspection Institution, there wasn't exactly a ombudsman institution in Turkey. Despite of the fact that these agencies and institutions still continue their activities, there isn't any conflict of authorization or jurisdiction between Government Inspection Institution and these institutions and agencies.
