Abstract (EN)
This study where we have examined the crime of theft under Turkish CriminalCode numbered 5237, is comprehensive since it aims to assess the simple and qualifiedtypes of crime as a whole. This study consists of four parts.In the first section, the definition and description of the crime of theft, itshictorical development, in comparison with similar offenses and how it is regulatedunder comparative law with a few examples are handled.In the second section, the legal benefit which the law protects and the elementsof the crime of theft have been examined.In the third part, the major status and the mitigating causes of the crime of theft,the personal impunity circumstances, the personal circumstances that requires reductionfrom the sentence and the effective repentance circumstance have been examined.In the fourth and final section of the study, the criminal attempt to the crime oftheft, consecutive sentence, accompliceship, investigation and prosecution procedureand the sanction of the crime are have been examined.
