Case of cancellation of saving from the protection of proprietary receivables

The state needs to be able to fulfill public services. There are many public revenues along with the most important and guaranteed tax of state revenues. Public revenues gain public acceptance when it comes to the collection stage. The collection of public receivables quickly and easily is important for the continuity of public services. For this reason, legal arrangements have been made by lawmakers to collect public receivables quickly and easily, as well as to ensure the collection of public receivables before and after the collection phase. Provisions relating to the follow-up and collection of public receivables in Turkey are regulated in Law No. 6183 on Procedures for Collection of Public Receivables. Provisions regarding the methods of protecting public receivables as well as the provisions regarding the quick and easy collection of public receivables are included in the said sentence. The most important of these methods are; Collateral acquisition, precautionary accrual, precautionary seizure and the right of priority. There are many ways of protection. The cancellation case is a case to determine the invalidity of the public debtors 'savings on the value they deduct from the assets of the debtor who does not pay debts, and to collect public claims over the plaintiffs' values. The cancellation case may be opened on account of the savings and the treatments of the debtor by the law. In his opinion, the savings that can be canceled are not counted as limited. A general description has been made and it has been expressed that the issue of the cancellation case will constitute the broadest sense of the savings which would be detrimental to the creditor's creditor's claim. The subject of this study is to examine and evaluate the cancellation of the dispossession, which is one of the protection methods of the public, in all aspects.
