Abstract (EN)

Within the scope of the labor law numbered 4857, there is the concept of discrimination on the grounds that employees are not treated equally. One of the sub-bases of this discrimination concept is the gender inequality created by socially based elements. The gender discrimination that female employees are exposed to during their employment can also bring about wage discrimination. Today, the difficulties in women's employment still continue. Women are exposed to gender discrimination and face obstacles in their working life in the recruitment processes, working processes after being hired, and in the processes of accessing the opportunities they can obtain in working life. In line with these obstacles, women should be specially protected in terms of working conditions in order to increase women's participation in employment, to prevent working women from losing their jobs, and to prevent the aforementioned negativities. The aim of the study is to evaluate the legal regulations in the process of establishing, maintaining and terminating the employment relationship of female employees within the framework of Turkish Labor Law and Social Security Law Legislation, international agreements and directives. As a result of the study, it has been concluded that Turkish legislation on the subject has been largely harmonized with international regulations. Apart from this, it has been determined that the deficiencies in gender equality and existing issues that are still contrary to international regulations and European Union legislation should be regulated. In addition, the regulations made in the legislation are not sufficient and should be audited in the implementation part. In other words, women's ability to benefit from legally recognized rights should also be under the control of the law. In addition, it was argued that women should work under equal conditions with men by preventing them from being exposed to gender discrimination, and it was emphasized that situations that could be experienced against women workers should be prevented.
