"al-Nawâzil" by Abu al-Layth al-Samarqandi critical examination and publication (From the taharah section to the end of the bay' section)

Abstract (EN)

In the fourth century AH, a new style of compilation in the Hanafi School of Jurisprudence appeared, gathering the opinions and reasons of other scholars within the School of thought. This compilation followed books that included the views of the three founding imams of the Hanafi School. The first of these works, known as vâkât or nevâzil in literature, is a book titled Kitâbü'n-nevâzil that was authored by Ebü'l-Leys es-Samarkandi, one of the Belkh region's canonists. In this study, the first half of the text was critiqued as part of a project that was targeting the entire work using the genealogical tree/stemmatic technique. Detailed information on the work's content was also provided in order to show the work's legal significance as well as significant judgments and assessments were made. All of the original copies that we were able to locate both domestically and overseas, as well as the virtual copies we were able to create by comparing these copies, were employed in the genealogical tree method. Thus, it was determined that the form acquired was the one that was most similar to the author's original text. Other Islamic manuscripts have been compared to the success of this technique, which is an alternative to traditional text criticism and other verification methods. It demonstrates that it is more accurate to critique the text in the same way. Additionally, it highlights the significance of the vâkât/navâzil category in terms of its rich juridical literature because it includes a variety of canonists' opinions and arguments.
