The transformation of religious court system based on Islamic law in Indonesia

The transformation of Indonesia's religious court system based on Islamic law is an essential study in the face of the dynamics of social change, law, and justice in a diverse and evolving society. This research aims to understand how Islamic law can adapt and grow within the framework of religious courts in Indonesia, which incorporates a variety of legal traditions ranging from colonial heritage to local wisdom still alive in society. The research method used is normative legal research, particularly suitable for studying legislation related to the religious court system and Islamic law. This method focuses on theoretical analysis, interpretation of existing legal rules, and understanding the extent to which the current regulations can support the transformation of Islamic law in the religious court system in Indonesia. The research revealed that the transformation of the religious court system in Indonesia is not just a formal change in structure and procedure but rather a turning point that reflects a deep commitment to integrating Islamic law into the judiciary. This transformation process encompasses various aspects of Islamic law, such as marriage, divorce, inheritance, family law, and Islamic economics, all of which have an essential role in providing a solid foundation for Muslim citizens to live by their religious teachings. In this context, the religious courts are not only acting as law enforcement agencies. Still, they are also at the forefront of ensuring sustainability and justice in various spheres of life, particularly economic activities, by Islamic principles. As such, religious courts are essential for realizing substantive justice across the entire spectrum of life of Muslim communities in Indonesia.
