Abstract (EN)

The criminalization and the punishment of consensual adult sexual intercourse between the close relatives (kin) are older than criminal codes. Reasons of avoidance from such relations and disapproval of other people's relations are examined within the scope of philosophy, sociology, anthropology, biology, medicine and criminology. In comparative criminal law, it is stated that the sexual intercourse must be criminalized by means of explanations by these disciplines in different terms and contexts. Nonetheless, these allegations should be examined in terms of criminal law theories, purpose of punishment and criminal policy. In this context, the statements about different actions made through different terms and opinions are used to legitimize the punishment of the different action. While in Turkish criminal law doctrine criminalization of such relations are predominantly accepted, Turkish legislator continues to its approach, during legislative actions and process, to not to punish such relations.
