Abstract (EN)
The object of this research is to identify the legal regime of the concept of passive confiscation, also known as legal confiscation in practice, which arises from acts that must be established by the administration but are not established. Evaluations have been made upon the origins of the concept and its developments in judicial decisions and legislation. There is also an effort to determine the relations and differences between passive confiscation and similar concepts. The current and ideal scope of passive confiscation and its present and probable conditions are specified. Particular situations that occur during legal procedures have been stated. Lastly, there is also a discussion regarding the causes of administrative acts which result in passive confiscation on real property and how to prevent this interference that violates the right of property.
