Compulsory licensing within the framework of intellectual property law

Intellectual property law has a significant place in today's consistently changing and globalizing world. As a consequence of such changing and globalizing, social and economic relations and business connections between the countries, companies and individuals also make progress and the competition increases day by day. Therefore, intellectual property law has a considerably dynamic structure in today's world. In this regard, the matters regarding protecting and limiting the intellectual property rights become more and more significant. Thus, compulsory licensing is also an important mechanism with related to limiting the intellectual property rights under specific conditions. Within the scope of our dissertation, first we give information regarding the history and development of the intellectual property law and the rights subject to the intellectual property law to ensure intelligibility of the characteristics of the intellectual property rights. Afterwards, we review the licenses including compulsory licensing as a subtitle and licensing agreements to be able to make comparison with the practices of compulsory licensing and to see the applicability of such subjects to compulsory licensing. In the final chapter, we aim to explain the compulsory licensing which is the main subject of our dissertation by describing the development of the compulsory licensing system, its place in the international platform, its terms and characteristics in accordance with the Turkish Law.
