Abstract (EN)
In this study, it has been examined how computer games, which have become an inseparable part of the daily lives of some people, are protected within the framework of intellectual property law or rather how they can be protected. The term computer game has been used as an inclusive concept for digital games, video games, audio games, and mobile games. While examining the topic, foreign legal systems and international situation were set forth in addition to Turkish law, and The narrative has been strengthened with the help of domestic and foreign court decisions. The study has been penned not only with the consideration of the Law on Intellectual and Artistic Works but also by paying regard to the Industrial Property Law and other legislation. Considering the ever-expanding social and economic impacts of computer games, game broadcasts on broadcast platforms such as Twitch and YouTube, modes developed by players, e-sports competitions, it will be seen much more clearly that this field cannot be left to itself. To keep the focus of the study on the topic of protection of computer games in intellectual property law, unnecessary evaluations such as examining the types of games and singly explaining the game platforms were avoided. For this reason, in this study, the history of computer games and game development processes are briefly explained, the protection status of computer games within the scope of current legislation, domestic and foreign doctrines regarding protection are examined, information is given about the contracts concluded in the computer game sector, and in addition to this, recommendations on how to solve the determined problems are offered.
