Abstract (EN)

The Islamic concept Haram (forbidden), consists of two components; 'lizatihi' and 'lighayrihi'. This dissertation, explores the development of the concept, 'haram lighayrihi' and how it became a late denotation/expression used in Usul'i literature. It is important to note that no clear description has been made to define this term Chapter one of this dissertation reviews litterature on the birth, development and usage of the concept 'haram ligayrihi'.Chapter two investigates the examples given in Usul'i literature on the 'haram lighayrihi' concept and determines if they are legally accurate. An emphasis is given towards the relationship between 'haram lighayrihi' and 'nehiy (prohibition)-fesad (irregular)' in order to examine if the concept is: sihhat (valid), butlan (void) or fesad (irregular). The final chapter, examines the outcomes of the development and application of the "haram lighayrihi" concept in Usul al-fiqh (Principles of Islamic Jurisprudence).
