Abstract (EN)

As pointed out in article 1088-1118 of Turkish Commercial Law, the shipmaster that has been given the authority to represent the shipper possesses certain authorities that vary depending on the status of vessel whether being in the port or on the voyage with other duties and responsibilities related to those authorities. Featuring an important position according to Turkish Trade Law and other relevant laws, the master's legal status should also be clearly pointed out in respect of Labor Law. In general, master should be considered as the representative of the employer since he is the person representing the shipper/owner on board. This doesn't change the fact that the master is a seaman. The master shall benefit from the rights that the labor law entitles the seamen/workers and shall be subject to the obligations thereof.
