Rulings derived by Hâkim el-Cüşemî from the indications of verses "Specifically regarding surah al-ma'idah"

Tafsir studies cannot be read independently of the mufassir. All tafsirs are shaped, from various aspects, within the framework of the mufassir's ideology . As human beings, mufassirs have thought and produced works within the framework of different ideas and assumptions. In this study, we will try to address the interpretations made by al-Jushami under the heading of ahkam in Surah al-Ma'idah. The interpretations he put forward under the heading of ahkam will undoubtedly reveal our mufassir's fiqhi and kalami identity. We believe that examining the differences in the perspective of a different madhha, due to his being a Mu'tazili mufassir, will provide us with important perspectives. Mufassirs have made sectarian interpretations by interpreting Quranic verses within the framework of their own madhhabs to solidify their positions. Al-Jushami, from this perspective, also resorted to sectarian tafsirs. In fact, in some places, he explicitly states that he interpreted the subject according to the understanding of the great scholars of his madhhab, even mentioning his teachers by name. In this study, taking into account the general criteria of the science of tafsir, we will not only convey our mufassir's interpretations but also offer critiques where we deem it necessary. Undoubtedly, while holding it as a principle not to disrespect any of our scholars who have produced works with sincere intentions, regardless of their madhhab within the great Islamic scholarly tradition, we view our sectarian differences as a source of richness. When it comes to understanding verses of the Qur'an, it is not a consistent approach to regard only the interpretations of other schools of thought as sectarian, while ignoring the sectarian nature of one's own school's interpretations. Critically examining the interpretations of one's own school within an academic framework is also a significant scholarly achievement. In this study, our aim is not to pit sectarian views against one another, but rather to analyze different perspectives in order to arrive at sound interpretations of the verses.
