Abstract (EN)
In this study; we were discussed about the effect of unjust provocation in the context of killing crimes and its effect on the determination of punisment. The basis of our study is the unjust provocation institution regulated by the Turkish Penal Code. After all, it has been tried to examine in detail some situations frequently encountered in operation, in terms of killing crime types and ehether unjust provocation can exist together; the effect of the last unjust provocation on the individualization of punishment was addressed. In this study, special attention has been paid to relevant judicial decisions.
