Abstract (EN)
As in all countries, bringing Treasury properties into the economy in line with development goals is of great importance for Turkey as well. The sale of these properties not only generates revenue for the state but also provides land to investors, thereby contributing to increased investment and employment opportunities. This study examines the sale of Treasury-owned immovable properties during the period 2018– 2022 under the provisions of the State Procurement Law No. 2886, as well as the direct sales to coowners under paragraph (c) of Article 4 of Law No. 4706 on the Utilization of Treasury-Owned Immovable Properties and Amendment of the Value-Added Tax Law. Additionally, it addresses the direct sales of lands removed from forest boundaries (2/B areas) and agricultural lands under Law No. 6292. The study explores the sales processes, identifies the challenges encountered during these processes, examines their causes, and provides recommendations for solutions. Relevant legal provisions, activity reports and general notices of the General Directorate of National Real Estate, and reports of the Court of Accounts were analyzed. The sales transactions were first assessed on a national scale and then analyzed through the Dursunbey National Real Estate Office's transactions using the National Real Estate Information System (MEBIS). The trends in sales over the years, causes of negative outcomes, and demand patterns were evaluated. The study concluded that challenges such as the complexity of legislation, insufficient personnel within the National Real Estate Administration, irregular property record-keeping, and inaccuracies in determining market values significantly hinder the effective execution of sales processes for Treasury-owned immovable properties.It was found that incorporating Treasury-owned properties into the economy increases public revenues and that addressing the challenges encountered in these processes would further enhance this impact. To resolve these issues, adopting integrated approaches that encompass all details, along with planned and disciplined regulations, would help maintain a systematic order, ensuring more efficient processes. Simultaneously, this approach would contribute to achieving more sustainable and balanced outcomes by considering the multifaceted nature of the challenges.
