Mobbing at workplace from a legal perspective

Abstract (EN)

There are constant conflicts between employee and employer and among the workers due to the obligation for people in different characters for being all together in professional life. These conflicts can be faced in every business since very old times. The psychological harassment at workplace which becomes a social risk in present, is a phenomenon occurred by these conflicts. The mobbing concept in the workplace which is as old as the professional life, has reached to a detailed definition in the last years and has become one of the most discussed legal entities.The psychological harassment in the business is a violent psychological or physical pressure applied to the employee and is a systematic process causing negative and persistent affects on the employee which cannot be doped. The purpose here is to have the employee resign with his own will by harassing him. It is so natural that this situation affects the business and society as well as the employee.This study aims to identify the concept by considering the elements of the psychological harassment at workplace and to examine its place in Turkish law with the applicable legal methods under the legislation and court practices. Besides, this study also considers the place of the mobbing in the comparative law and within the frame of the different approaches.
