In the scope of zoning law punishments arise from zoning crime and practical issues they cause

People have been faced with the need for shelter since ancient times. With the icrease in population, this need has continued to grow. Consequently, structures that would meet people's housing needs began to be built. The growing structures formed buildings, and buildings gave rise to cities. This sitution has brought about some urban problems, such as environmental pollution and urban sprawl. Administrative units have been established for urban planning and cities have been established through various projects to ensure urban order. However, rapid population growth and migration from rural areas to cities have led to citizens attempting to meet their housing needs themselves. This situation has undoubtedly caused unplanned urbanization, particularly in large cities.In our study, the issue of the responsibilities imposed on individuals within the framework of the Turkish Criminal Code and the Zoning Code as a result of the construction of increasing illegal structures in the majority of the cities mentioned above is addressed. In this context, our thesis consists of two sections. In the first section, the basic concepts of Zoning Law are discussed, examples are given regarding how these concepts are evaluated by the Court of Cassation, and explanations are provided regarding how these concepts are evaluated in other laws besides Zoning Code. In the second section, the conditions under which unlicensed structures become illegal in relation to the offense of causing zoning pollution and how it is evaluated within the scope of the Turkish Penal Code are examined. The type of criminal liability of a person who commits the offense of zoning pollution is illustrated through examples of Court of Cassation decisions, and the effects of the amnesty for zoning violations on this offense are discussed within the framework of the victim, subject matter, and elements of the offense. The aim of our study is to minimize, to the greatest extent possible, the occurrence of illegal construction through the systematic application of the Zoning Law and the Turkish Criminal Code and the enforcement of penalties on society through criminal action.
