Abstract (EN)
Besides the responsibility of construction's owner that is generated from Code of Zoning, the liability of private law will also become a current issue due to the harmful effect on the usage of the construction against the zoning law. Within this context, there has been a responsibility of the construction's owner towards injured party due to impair of the construction in accordance with the terms of Turkish Civil Law and Turkish Code of Obligations. In literature, the destruction and fine santions which are implemented via the Code of Zoning due to constructions against the zoning law have been investigated but there has not been any investigation yet about the owner's duty in construction issued from private law against the injured party. Taking into consideration the fact that the intimate relationship between zoning law and private law, it has been tried to shed light on the lacking of that issue in my thesis.
