Abstract (EN)
As a result of work accident, both compensation claims of the employee or right holders and recourse of the Social Security Institution to the employer are the subject of employers' liability insurance. Employers' liability insurance which provides private insurance protection against decrease or such risk of decrease in asset of insured due to its civil liability has a double effect protecting the employer and the injured employee. Accordingly, employers' liability insurance might be a compulsory insurance especially in sectors (such as mining, construction etc.) containing high occupational risks. In our study, firstly, legal nature of employers' liability has been discussed. Subsequently, the basic principles of liability insurances, the theories used in determination of the risk in these insurances and the duties related to the risk are treated. Finally, employers' liability insurance in Turkish law has been examined.
