Abstract (EN)

The law of enforcement is a sanction law which includes a control to ensure that the debtor does not pay his debt in due time by obligee's requisition –of state aid. In the case of public debt enforcement, a separate procedure will be implemented. For the purpose of financing public services of the state, the provisions of Law No. 6183 On Collection Procedure Of Assets about drafting procedure of public debt were arranged for the follow up of the receivables arising from administrative obligations as a result of the administrative power. Due to the qualification of the public receivable, there are provisions that aim to guarantee the collection in Law No. 6183 On Collection Procedure of Assets these provisions are designed to enable the collection of public receivables in a fast and effective manner. These are, under the caption of the Protection of Public Receivable; Request for Collateral, Precautionary Foreclosure, Precautionary Accrual and under the caption of Other Protection Provisions; Preemptive Right, Transactions to be Made without Public Receivable. The subject of this study is revocatory action which is included among other protection clauses of the public receivables. The revocatory action is aimed at the collection of the public receivable by canceling the savings of the debtor's assets. The aim of the study is to examine all aspects of revocatory action by public enforcement law in Law No. 6183 On Collection Procedure of Assets provisions and make a comparison with the provisions of the Law No Bankruptcy And Enforcement including case law.
