Abstract (EN)
In the study, it was observed that in the Republic of Korea, the scope of crimes which the prosecutor can initiate an investigation has been narrowed down, the police have a more active role in the investigation and the order and instruction relationship between the prosecutor and the police has been transformed into a cooperation relationship. For the aforementioned reasons, the procedural institutions and decisions that end the investigation phase are more diverse compared to the Turkish system. The scope of crimes that can be referred to conciliation is wider than our system. In the postponement (suspension) of the opening of a public lawsuit; suspension of prosecution/indictment is recorded in the suspect's criminal record, and the only way the suspect can appeal against the postponement decision is to individually apply to the Constitutional Court of the Republic of Korea.
