Nullity and lapse of testamentary dispositions

The subject of this thesis is the nullity and the lapse of testamentary dispositions. The first section of the thesis reviews generally the concepts of testamentary disposition and nullity with their types. This section also briefly mentions about the different and common aspects of the nullity and lapse of the testamentary dispositions. In the second section of the thesis, the nullity of the testamentary dispositions is examined in detail. In this regard, firstly, the reasons for the non-existence and absolute nullity of the testamentary dispositions are discussed, and then the reasons for cancellation are examined. Under the heading of cancellation of testamentary dispositions, the legal causes for cancellation articulated in Turkish Civil Code such as incompatibility, injured discretion, a contradiction to law and ethical codes and procedural defects are separately explained. Besides these, in this section, the special situations of the sense of lesion and the removal of protective inheritance, which led to the cancellation of the testamentary dispositions, are also discussed. In the third section of the thesis, the cases of lapse of the testamentary dispositions are examined. In this section, the difference between the lapse of the testamentary dispositions and the nullity of the testamentary dispositions are explained, and then, the solutions for some possible significant problems that may arise as consequences of the lapse of testamentary dispositions are sought.
