Abstract (EN)
The execution system must be effective and understandable. The effective execution of sentences imposed by criminal courts is very important for both satisfying the victim and reintegrating the offender into society as a beneficial individual. While terms such as 'execution prosecutor, prison, mathematical operations' come to mind when we mention execution law, there are many topics that need to be explained beyond this. We observe that inmates and detainees do not know how to act against the actions, decisions, and activities of the public prosecutor and the penal institution, and even lawyers, public prosecutors, and judges experience hesitation in understanding the execution and its procedures. In this study, after briefly mentioning the stages of the execution system, the articles regulated in the Law on Execution Judges No. 4675 will be explained. Especially following the clarification of the nature, authority, and duties of the execution judiciary, there will be a discussion about how to proceed in the complaint process conducted after the petitions submitted by the convicted and detained persons, and the types of decisions that will be made as a result. Thus, a perspective will be provided on what investigations need to be conducted by the prison and the public prosecutor regarding the requests of the detainees and convicts. At the same time, it will be understood how the execution judge addresses the issue concerning the complaint of the detainee and convict within the context of constitutional rights. In the second part, the types of disciplinary penalties that can be applied to convicts and detainees during their time in the penal institution will be explained, followed by an examination of how the disciplinary investigation is conducted, what should be considered during this investigation, and evaluations regarding the complaints made to the execution judiciary concerning the decision issued by the institution as a result of this investigation.
