Analyzing recourse cases in social security law related to construction works accidents

The aim of this study is to examine in detail the accidents in construction jobs and to determine the measures that prevent the occurrence of these accidents as a result of this review. Firstly, to get the most detailed information, the place where this detailed information can be obtained is found out. It is concluded that the needed information can be found within the expert reports and expert witness accounts. Hence, 152 expert reports out of SGK database are examined. The expert reports are analyzed according to month, day and hour of incident, liability rates in the accidents, the disability rate of survivors, the latest situation of disabled survivors, construction and project type, the presence of personal and collective protective measures, task of the survivors at time of the accident, the specialty of the survivors, height of fall if the accident is a falling down, the age of the survivors, and the causes of accident mentioned in expert reports. The cases are studied further according to the average accidental damage incurred to Social Security Institution and the average right of recourse litigation for each accident from the employer. The data is also evaluated statistically considering the results within themselves.
