Abstract (EN)

The period in which the employer does not pay wages for a certain period and the employee does not work, is called unpaid leave provided that other conditions are met, and is one of the cases suspension of the employment contract. Especially in the unpaid leave offered by the employer, it is aimed to overcome the negative effects of economic difficulties and extraordinary crisis periods on the workplace. Although the terms and conditions of unpaid leave are not regulated separately in the law, but there are special regulations about some of the unpaid leave enforcements. However, since it means the absence of the wage required for the worker to sustain his/her life, the conditions, sources, provisions, and results of this practice need to be examined and determined. Although the enforcement of unpaid leave, which started with the agreement of the parties, is subject to certain legal limitations as it creates a fundamental change in working conditions, considering the importance and widespread use of unpaid leave, its boundaries should be drawn with a more detailed and separate general article in law.
