Abstract (EN)
Penalties for crimes related to drugs and stimulants are regulated in Articles 188, 190, 191, 192 of the TCK No. 5237 (Turkish Penal Code); Manufacturing or trading in or facilitating the use of criminal substances is regulated as a crime in the law.In Article 189 of the TCK, the implementation of security measures against legal persons and in Article 192 effective remorse in drug and stimulant crimes are regulated.This study, on the other hand, is limited to Article 188 of the Turkish Penal Code in terms of crime investigation. Within the scope of our thesis, first of all, the definitions of narcotic and stimulant substances were made, the types of these substances were explained, the historical stages and international conventions were mentioned, then the basic and qualified elements, sanctions, specific forms of appearance and active regret are given under separate headings.In order to show the practice and to shed light on some issues where there is no unity in practice, the decisions of the Supreme Court are also included, doctrinal views and finally our opinion are explained.
