Temporal aspect of the application of The Constitutional Court's annulment decisions

This thesis deals with the temporal aspect of the application of the Constitutional Court's annulment decisions. Temporal effect of the Constitutional Court's annulment decisions was examined firstly in terms of the legal consequences of unconstitutionality. For the purpose of concretization of the consequences of the annulment decisions in practice, regulations regarding the date on which the annulment decision comes into effect and the temporal effects of the decisions, were evaluated together with the judicial decisions regarding application of those regulations. Although non-retroactivity of the annulment decisions is the basic rule in Turkish law, this inquiry shows that the said decisions are often applied retroactively in practice. In this regard, it has been tried to put forward different judicial decisions on the temporal application of annulment decisions and issues arising from the temporal effects of the annulment decisions and suggestions for the solutions of those issues.
