State inspection and supervision of ministry of trade regarding joint stock companies

This thesis deals with the state inspection and supervision of Ministry of Trade regarding joint stock companies in the scope of the Turkish Commercial Code, Law No. 6102 (TCC). Considering joint stock companies' great impact on the national economy and their key roles, it could be alleged that state inspection and supervision over joint stock companies is crucially important and necessary. In this respect, significant and comprehensive duties and powers in relation to foundation, operation and also dissolution process' of joint stock companies are vested in the Ministry of Trade. Since there is not a one-stop legislation to look into all the above-mentioned duties and powers and the relevant legislations are scattered in various provisions of TCC and other legislation, such legislations are closely evaluated and elaborately examined in this study. In addition, suggestions are put forward for the solution of the problems that may likely to arise by emphasizing controversial points in concern with the exercise of these powers.
