Evaluation of the Turkish law on intellectual and artistic works within the framework of the exceptions in the European Union directive on copyright in the digital single market

In today's information age, the acceleration of transmission with the world wide web technology has shaken the foundations of the economy by creating new business models. In the face of the development of digital business models based on creative content that includes copyright protected works and other subject matters, the current copyright system has begun to fail to respond to current needs. The European Union has responded to current challenges in this context by adopting the Directive on Copyright in the Digital Single Market, in line with its Digital Single Market goal. The legislative steps in the European Union are relevant for Turkey, as its harmonisation process with the European Union continues. The aim of this study is to detect and evaluate legal steps to be taken in Turkey in the scope of the new exceptions introduced by the Directive, following an examination of the copyright system in Turkey and explanation of the new developments in the European Union. In the first part of our thesis, the scope and limitations of the copyright legislation in Turkey will be examined within the framework of the Law on Intellectual and Artistic Works, and the legal doctrine. The second part of our thesis will explain the new legal provisions brought with the Directive on Copyright in the Digital Single Market in the European Union. In the third part, the new exceptions of the Directive will be evaluated, and our opinions on the steps to be taken in Turkish law will be explained.
