Problems within dam expropriation: Kayseri Gümüşören Dam case

In our country, irrigation, poteble water, energy and dam building which operations on the purpose of flood protection projects are high cost. The main expense which increases the cost of the dam is the expropriation. State Hydraulic Works (DSI) is the primary authorized public institution for the construction of the dams today. DSI, which uses a large part of our country's budget allocated for investments, uses a significant portion of its budget for the expropriation costs. In this study, Gumusoren Dam located at Gumusoren Province of Kayseri made by the General Directorate of State Hydraulic Works has been selected as the application area and every aspect of expropriation activities were investigated in detail. Expropriation activities in the application area, bottlenecks and examined solutions have been studied. Additonally how to develop an expropriation activitiy for the remaining settlements in the dam basin and the judical decisions that are made were examined in detail. The aim of this thesis' studies is to shed light on new projects which will be done by examining all aspects of the expropriation process which caused the delay of the dam construction work. Information related to definition and historical development of expropriation, expropriation legislation and the European Court of Human Rights in the lawsuit due to expropriation are given in the first part of this study which was prepared as a master's thesis In the second part, literature review has been done about research on expropriation In the third section information about the activities of General Directorate of State Hydraulic Works is provided. Also detailed information about the process steps in the expropriation Project is given. In the fourth section general information about the Gumusoren Dam Project and information about the expropriation activities are provided. The problems encountered in Gumusoren Dam Project expropriation stage and solutions to these problems are presented in the fifth section Conclusion section provides some solution recommendations about expropriation activities, how they can be more productive, quicker as well as maintaining and increasing the social balance settled in dam areas by not destroying socio-economic structure of the local people. This section also provides some suggestions regarding cost control, minimizing expropriation lawsuits and how to perform the expropriation activities without damaging the government-citizen relations.
