Material compenation and spiritual compensation in divorce cases

The subject of this study is the Material Compensation and Spiritual Compensation, which are the financial consequences of the termination of marriage by divorce. The legal basis of the material and moral damages claim arising from the divorce is Article 174 of the Turkish Civil Code. In this study, the concept of material and non-pecuniary compensation, the conditions of these compensation, the criteria to be taken into consideration in determining the amount of compensation and the rules of procedure to be applied in these cases are discussed. While explaining the subjects, the doctrine and the Supreme Court are frequently mentioned. The study consists of four parts. In the first part, the general framework of the divorce, the second part of the financial compensation, the third part of the non-pecuniary damages and finally the fourth section the rules of procedure in these cases were examined.
