Özet (EN)

The receivables arising from the check, which is one of the bills of exchange, are subject to timeout as a rule. A check based credit right expires if it is not claimed or requested within the time specified in the law. If the borrower defends time-out, the creditor's opportunity to assert and obtain this right by the state ends. The Turkish Commercial Code (TCC) numbered 6102, unlike the annulled TCC, envisaged a three-year expiry period (m.814) such as bonds and policies. In order for the timeout period to be processed, the right to apply (m.810) must have been originated first. The right to apply for a check that has not been submitted within the deadline, or that has not been paid partially or completely, and whose non-payment has not been duly determined, will not have arisen and this right will not be expired. The timeout period will begin after the end of the submission deadline. The three-year time-out period for the right to apply, which one of the check borrowers has against another check borrower, will start from the date the check borrower has paid the check or the check has been brought against him by lawsuit. No special arrangements were made for the timeout withdrawal in checks; it referred to the policy provisions. The reasons that stop the expiration periods that the right to apply in the check are not regulated in the TCC. Keywords: check, timeout, pull elements, submission, application
