The role of the United Kingdom parliament in protecting human rights as an example of the new commonwealth model of constitutionalism

The new Commonwealth model of constitutionalism is considered as a hybrid model, which includes some features of the traditional legislative supremacy system and the traditional constitutional supremacy system. The Human Rights Act, enacted in the United Kingdom in 1998, is an example of the new Commonwealth model of constitutionalism. In the first chapter of the thesis, the new Commonwealth model of constitutionalism is examined based on Gardbaum's theory and in the light of the doctrinal views and the samples. In the second chapter of the thesis, the example of the United Kingdom Human Rights Act is focused on and the role of the United Kingdom Parliament and the United Kingdom Joint Committee on Human Rights, working within the parliament, in the framework of this act is displayed. In this way, it is tried to show how the legislature can be effective in protecting human rights in a constitutional system.
