Abstract (EN)

It is clear that an unfair situation will arise in terms of the lessor if the rental price is not paid as a result of an extraordinary situation in workplace lease agreements. Likewise, it would be unfair to expect the tenant to pay the entire rent despite the extraordinary situation. Although the parties are obliged to fulfill the acts they have undertaken in accordance with the principle of pact and fidelity, in the event of an extraordinary situation such as the Covid-19 pandemic, the strict application of this principle also constitutes an injustice. In the study, first of all, which lease agreements can be accepted as workplace lease agreements and the qualities of workplace rental agreements were examined. Afterwards, the legal nature of Covid-19; The concepts of force majeure, impossibility of performance and excessive difficulty in performance are discussed. Finally, with the effect of Covid-19, the legal remedies that can be applied in terms of workplace lease agreements and their terms and consequences have been evaluated. In the study, the effect of the Covid-19 pandemic, in which the effects are still being seen, on workplace lease agreements; taken together with precedent court decisions. During the pandemic process, the principles of applying to the adaptation agency, which is the most frequently discussed in terms of workplace lease agreements, have been examined in detail under a separate heading.
