Özet (EN)

When talking about discipline, although there are compelling measures and punishments in our minds, there is discipline as a term in the sociological sense of modern societies in terms of obeying the principles and rules. In this sense, it is necessary to ensure order in every field within a disciplinary understanding in order to create a modern society. The reflection of the discipline to judicial realm has been found to punish the rules which are compulsory to be complied with in an institution or organization, and to punish those who do not comply with the benefit of the institution. The main purpose of these fines, called disciplinary sanctions, is to protect corporate reputation and to achieve public interest by providing order and continuity in public services. Because public interest is an abstract concept, the general framework of the doctrine and practice has not been asserted. This abstraction makes it difficult for administrative jurisdictions to identify their disability in the juridical purpose of conducting audits. In this study, the principles and opinions that are put forward in the light of the judicial decisions for the purpose element, based on the elements of the administrative process, are brought together. In this respect, it has been shown that the objective of public interest cannot be achieved only with disciplinary punishments should be attained at the same time as a constructive character by qualified and capable judges and it is revealed to be chosen not only the way of punishment but also rewarding in order to increase efficiency in the institutions.
