Abstract (EN)

Our study consists of four chapters. First chapter discusses the topic of this study, purpose, significance, method and limitations of the research. In the second chapter, we have compiled information about the order in which Imam Malik used the evidence that influenced his legal opinions in order to understand his rationale. In the third chapter, we explained the characteristics of school of hadith and the school of ra'y with the basic information about these schools. Then, in the same chapter, in order to determine the position of Imam Malik between these two schools, we compared the hadithism and the ra'ysism of Imam Abu Hanifah, one of the most important names that he has accused with ra'ysism, and the ra'ysism and hadithism of Imam Malik. In the fourth chapter, we have given examples where Imam Malik ignored hadiths and he established his legal opinions on the basis of the ra'y.
