Mediation in labour disputes in Turkey and in the law of different countries

Mediation has a profound importance for legal systems, with the effect on labour relations that need to be protected regarding their economic and social significance. It provides a faster, cheaper, and more protective effect on party relations than dispute resolutions involving judgment. The regulations regarding the mediation for labour disputes in Turkey and in the law of different countries have different approaches to compliance with the original structure of the labour law. The study area of the thesis is to examine how the regulations made in individual labour disputes in Turkey and in the law of different countries to protect the original structure of labour law. The thesis presents a model proposal for Turkey that fit our society and legal system by comparing country profiles. In this thesis firstly, we will examine the alternative dispute resolution methods and the situation in Turkey. After that examples from the law of different countries will be examined. In the last part, we will share our model for individual labour disputes which we designed by comparing the country profiles.
