The legal nature and position of the action for annulment of objection within enforcement law

Abstract (EN)

As a rule, debtors are expected to fulfill their obligations voluntarily, without any form of coercion. However, when a debtor fails to perform the obligation willingly, the creditor cannot directly satisfy their claim from the debtor's assets based solely on substantive law. In such cases, the creditor must either file a lawsuit against the debtor or initiate an enforcement proceeding. One of the procedural mechanisms available to the creditor is the execution without judgment through general attachment proceedings ("genel haciz yoluyla ilamsız icra takibi"). Notably, this enforcement route does not require the creditor to possess any supporting document or instrument of debt. While the legislator grants creditors this procedural advantage, it also safeguards the debtor's rights by allowing the debtor to lodge an objection to the payment order, thereby suspending the enforcement process. Following such an objection, the creditor must, within the statutory peremptory period prescribed by the Enforcement and Bankruptcy Law, pursue one of the available legal remedies to annul the debtor's objection. Among these remedies is the action for annulment of objection ("itirazın iptali davası"). The action for annulment of objection is brought before the general courts and adjudicated in accordance with the rules of ordinary civil procedure. The legal characterization of this action determines its procedural consequences and enforcement implications. Furthermore, such an action may arise in connection with various types of enforcement proceedings regulated under enforcement law. In this study, the various doctrinal opinions concerning the legal nature of the action for annulment of objection are examined. After clarifying the position of this action within the framework of enforcement law, the study further analyzes its distinctive legal characteristics.
