Özet (EN)

Personal status refers to the laws of the country in which the person's rights and law are subject to. The basis of this is the competence of rights. Although the right and capacity to act are the most basic concepts of law, they are the institutions that enable individuals to have rights and to be indebted with their own actions. International private law, on the other hand, is a branch of law aiming to determine the law to be applied to the subject and the legal institutions in disputes involving foreign element. The main subject of this study is to determine the law to be applied to the real and legal capacity of real persons within the scope of private international law and to examine the existing problems in this field. In this context, various legal systems will be analyzed by using comparative law and the most appropriate approaches will be tried to be reached regarding the issues and problems examined.
