Abstract (EN)

In my thesis, it is aimed to explain the muris collusion elements and trial procedures which are frequently encountered in practice and which do not have a special regulation place in the Code of Obligations. In our thesis, the mutative transactions of muris, which we encounter as absolute and relative type of Compensation, are discussed. Article 19 of the BK in which the relative collusion is regulated applies to the relative collusion operations of the Inheritance. The decision of İBK dated 01.04.1974 and the continuation of the merger of case law and the decisions of the Court of Cassation are also found to be applied. In my study, it is tried to explain the apparent transactions and hidden transactions of the Inheritance collusion. Within the scope of this issue, the decision of İBK dated 01.04.1974 and the caselaw and the decisions of the Court of Cassation are mentioned and mentioned in the subject.
