Abstract (EN)
Today, global climate change is an important problem that threatens the whole world. After the scientific evidence was put forward, many countries became aware of the importance of the issue and started to investigate the causes of climate change and solutions. One of the most important factors in preventing global climate change is increasing forest areas and preventing deforestation. To this end, many international panels and meetings were held and decisions were taken to mitigate climate change. Turkey joined the international panel which has been associated with climate change, it has become a party to several agreements in line with the country's economic and special conditions. It has assumed certain responsibilities under the agreements to which it is a party. One of these concerns the protection of forests and the prevention of deforestation, which are useful in preventing global climate change. In this context, the aim of this master thesis is to determine the level of our legal arrangements against international agreements in line with the importance of forests in reducing the effects of global climate change and to determine the direction of national legislation in order to prevent deforestation. As a result of the legislative analysis, it is possible to say that Turkish forest legislation is not yet at the level to fulfill the obligations of Kyoto Protocol and Paris Agreement in terms of deforestation. However, this does not necessarily mean the existence of negative and inadequate norms. Therefore, it will not be difficult to harmonize national legislation in terms of deforestation. Regarding this issue, regulations should be made especially on the basis of the law in the Environmental Law, Forest Law and all other relevant laws, provided that all criteria that fall below the "inadequate regulation" limit are observed.
