Abstract (EN)
This study includes examination and critical edition of commentary of al-Hidaya named Nihâya al-kifâya li-dirâya al-Hidâya (the sections of Marriage, Breast-Feeding and Divorce) by a prominent Hanafi scholar Imam Taj al-Sharia Omar b. Ahmad al-Mahbûbî. Mahbûbî's work is the second commentary of al-Hidaya and is a commentary in the style of "Qavluhû". The study gains importance in terms of containing some unknown information about the Central Asian Sadr al-dîn zâdah Mahbubî Hanafi scholar family, which came to the fore in the science and politics of the city of Bukhara. As far as we can determine, there are 36 different copies in the libraries of the world and 31 different copies in the libraries of Turkey. The parts included in our subject have been analyzed by comparing them with 4 of the 23 copies of the first volume, 21 copies in the Libraries of Turkey and 2 copies abroad. Our original copy is the copy of the Fatih National Library Feyzullah Efendi Collection, whose date of exception is 762/1360. This copy was referred to by Yahyâ b. Muhammad b. Muhammad al-Anbarî al-Husayni al-Sharif al-Baghdâdî, who referred to the oldest copies in Anatolia. The other copy of the response referred to by the complainant is the Izmir National Library Copy dated 714/1314. Our other response copies; Fatih dated 713/1313 and Kadızade Mehmed Efendi dated 912/1507, both of which are in different collections of the Süleymaniye Library. In his work, which he wrote in a clear style, Taj al-Sharia commented in detail on some closed sentences that he received from al-Hidaya by mentioning it as qawluhû. He expressed the preferences of the Hanafi madhhab before him, in his own age, and sometimes with evidence, with phrases such as "and alayhi al-fatwa/fatwa is on him", "and bihi yuftâ/fatwa is given with this", "and bihi na'huzu/we take it", "and alayhi al-i'timad/ there is trust in it", etc. In the footnotes in our study; The verses and hadiths mentioned by the author in the text have been made tahrij, and information about the mentioned place, person, personal names and poems is given as an index in the appendix. In the examination section, the ISNAD citation rules and the principles of the ISAM investigation guide were used.
