Investigating the implementation and effectiveness of the regulation on determination of error limits in land plans

Tajviz refers to the maximum error rate that can be accepted for the surface area of immovable properties in the measurement and mapping processes. The margin of error, formerly known as tajviz, is defined as the scientifically acceptable difference between the ground boundary of the parcel, which is determined according to the production method of the plan and the scale of the registered sheet, and the surface area registered in the land registry depending on the production method. Historically, in parallel with the development of measurement tools and methods used for the measurement of immovable properties, it has constantly changed. In the Ottoman period, the boundary determination procedures performed with primitive measurement tools and visual observations were replaced by modern measurement techniques over time. Since the Republican period, more precise measurements have started to be made with technological advances. Today, advanced technologies such as GNSS (Global Navigation Satellite System) form the basis of tecviz calculations and provide high accuracy. The Regulation on Determination of Margin of Error in Land Plans defines the margin of error in amendment procedures requiring application and surface area calculation and sets out the procedures and principles. In addition, the integration of modern mapping technologies into the regulations has contributed to the more effective evaluation of the margin of error and has played a role in many important issues such as the resolution of property disputes. We see that the old tecviz formulas are inadequate based on today's technology and do not have a scientific infrastructure. In particular, the fact that the old tajviz calculations do not take into account factors such as scale and production method will not allow for a proper evaluation. In this study, different immovable properties were selected from the studies conducted to date and the areas in the immovable properties were compared. In this study, the application of the Regulation on Determining the Limit of Error of the General Directorate of Land Registry and Cadastre and the calculations performed with the old tecviz method were compared and analyzed.
