Özet (EN)

In the 21st century, medical science and technology have made tremendous progress and medical processes have developed compared to the past. This development and progress has also brought about changes in the structure of people working in the field of health and led to the need for further specialization in all medical professions. This has led to the need for further cooperation between physicians. This cooperation can be in the form of vertical cooperation with hierarchy between them or horizontal cooperation with no hierarchical relationship between them. The type of cooperation that we call consultations means that a number of physicians diagnose and treat them together in the form of horizontal cooperation. In this study, how the consultation should be done in order to avoid legal problems, problems that may arise in practice and responsibilities of the consultant physicians were examined. In particular, if the patient suffers a damage due to a medical malpractice due to consultation, the principle of trust regarding whether the supervisor or the consultant physician will be responsible and the liability of care and loyalty in the Turkish Code of Obligations and joint liability are discussed.
