Abstract (EN)

Notification is a communication tool that provides information to legal action counterparts regarding the legal transactions made by the authorities authorized to issue the notification and document this process. Detailed regulation on the notification has been made in the Notification Law. With this law, notification is bound to strict form requirements. There have been important developments in the field of technology in the world. These developments also showed themselves in the transactions made by the state. These technological developments have also been reflected in the field of Notification Law. In this way, it was ensured that the notification is sent electronically. The first legal regulation on electronic notification in our country came into our lives in 2011 with the amendment made in the Notification Law with the law numbered 6099. Due to the benefit seen in electronic notification, the Project for Improving the Judicial Notification System has been implemented. With this project, with the new system that started to be implemented on 01.01.2019, with the law numbered 7101, the Notification Law Art. 7 / a provision has been amended. With this change, the electronic notification system and its scope have been expanded. This study focuses on the new system of electronic notification and its contributions and benefits to the right to a fair trial and the freedom to seek remedies. In addition, the inconveniences and disadvantages of the electronic notification system were also addressed.
