Subrogation under Turkish law of obligations

Abstract (EN)

Subrogation is a legal institution that provides an ipso iure transfer of the rights of the creditor to the performer in order to strengthen his/her right of recourse against the debtor. Since Article 127, the general provision regulating subrogation in the Turkish Code of Obligations, Law No. 6098 does not contain any direct principles, the main principles of subrogation are tried to be derived by referring to the subrogation of the surety, which contains the most comprehensive provision of subrogation. However, the conceptual and interest-based evaluations reveal that the concept of subrogation remains unclear. This thesis deals with the concept of subrogation, indicates its main features, conditions, legal structure and legal results, and focuses on the role of subrogation as a statutory instrument of recourse in the current recourse system of Turkish law of obligations. In addition, it determines the main principles of subrogation by evaluating individual characteristics of each case of subrogation regulated under the Turkish Code of Obligations. Finally, in this thesis, subrogation under insurance law is discussed.
